These Terms of Service (“Terms”) govern your access to and use of PropaneFL.com and the Florida Propane Supplier Guide, including the directory, business listings, rankings, quote-request forms, delivery-request forms, articles, tools, and related services offered through the website (collectively, the “Site”).

The Site is operated by PROPANE FLORIDA CO, doing business as Florida Propane Supplier Guide (“PropaneFL.com,” “Florida Propane Supplier Guide,” “we,” “us,” or “our”).

By accessing or using the Site, submitting an inquiry, or requesting to be matched with a propane supplier, you agree to these Terms and our Privacy Policy. Do not use the Site if you do not agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site or submit a service request.

By using the Site, you represent that the information you provide is accurate and that you have authority to submit the information associated with the property, telephone number, email address, or propane service request.

2. Directory and Lead-Matching Service

PropaneFL.com operates an independent directory and lead-matching service that helps consumers and businesses locate propane suppliers and related service providers.

The Site may provide information about services such as:

Residential propane delivery;
Commercial and industrial propane supply;
Propane tank installation, leasing, or replacement;
Automatic delivery and tank monitoring;
Cylinder refill and exchange;
Generator, appliance, or equipment propane service; and
Emergency or after-hours propane service.

We are not a propane supplier, utility, contractor, installer, fuel distributor, equipment manufacturer, emergency-response service, or government agency.

We do not personally deliver propane, install or inspect propane tanks, repair propane systems, enter properties, provide pricing, or perform any services described in directory listings.

When you submit a quote request, delivery request, contact form, telephone inquiry, or other request through the Site, you authorize us to use the information you provide to identify providers that may be relevant to your request.

Your information may be disclosed, transferred, licensed, or sold to one or more propane suppliers, contractors, service providers, advertisers, referral partners, lead buyers, or other businesses that may be able to respond to your request.

The information shared may include your:

Name;
Telephone number;
Email address;
City, ZIP code, or service location;
Requested service;
Tank or property information;
Preferred timing;
Description of the requested work; and
Other information you voluntarily submit.

We may receive compensation, advertising fees, referral fees, lead fees, commissions, or other payments when we share an inquiry, make an introduction, or when a provider obtains business through the Site.

Submitting a request does not guarantee that a provider will contact you, accept your project, provide a quote, offer the lowest price, have propane available, or complete the requested service.

You are not charged by PropaneFL.com merely for submitting a request unless a separate paid service is clearly presented to you and accepted by you.

4. Permission to Be Contacted

By submitting a service request, you expressly request and authorize PropaneFL.com and the provider or providers selected in response to your request to contact you regarding the propane products or services you requested.

Contact may occur by:

Telephone call;
Text message;
Email; or
Other communication method you provide or request.

Message and data rates may apply to text messages.

Your permission applies to communications reasonably related to your inquiry, including requests for additional information, estimates, availability, scheduling, service options, and follow-up concerning the requested service.

Consent to receive communications is not a condition of purchasing any product or service.

You may ask a provider to stop contacting you at any time. You may opt out of text messages by replying STOP. You may also contact us through the Site’s Contact page concerning communications initiated through a Site submission.

Submitting a request does not authorize unrelated marketing communications or automated or prerecorded marketing messages unless you separately provide any consent required by applicable law.

5. Independent Service Providers

Providers appearing on the Site or receiving leads from us are independent businesses. They are not our employees, agents, partners, representatives, franchisees, or subcontractors.

We do not control and are not responsible for a provider’s:

Prices, fees, fuel surcharges, or minimum delivery requirements;
Availability or response time;
Service area;
Tank ownership or leasing requirements;
Contract terms;
Licensing, registration, permits, insurance, or certifications;
Employees, drivers, installers, or subcontractors;
Equipment, vehicles, propane supply, or work quality;
Safety practices;
Warranties, refunds, cancellations, or dispute procedures; or
Compliance with federal, state, or local laws.

Any agreement for propane delivery, tank installation, tank leasing, equipment service, inspections, repairs, or other work is entered into directly between you and the provider.

PropaneFL.com is not a party to that agreement and is not responsible for enforcing it.

6. Provider Verification

You are responsible for independently evaluating any provider before hiring that provider or entering into an agreement.

Before purchasing propane or authorizing work, you should verify information important to your decision, including:

The provider’s identity and business location;
Current licensing, registration, and insurance;
Experience with the requested service;
Written pricing and applicable fees;
Delivery minimums;
Tank ownership or lease terms;
Cancellation and refund policies;
Warranties;
Safety procedures; and
Any required permits or inspections.

A provider’s appearance in the directory, receipt of an inquiry, profile description, rating, ranking, “verified” label, or score does not constitute a guarantee, certification, endorsement, or recommendation by PropaneFL.com.

7. Rankings, Scores, Reviews, and Business Information

The Site may display rankings, scores, summaries, service categories, review information, business descriptions, and other data compiled from publicly available sources, third-party platforms, business submissions, and our own editorial analysis.

Scores and rankings are informational tools. They may be based on factors such as publicly reported ratings, review volume, review recency, general review sentiment, and profile completeness.

A high score or prominent directory position does not guarantee that a provider is suitable for your property, budget, equipment, location, or service request.

Business information can change without notice. Providers may change ownership, employees, prices, service areas, availability, policies, qualifications, or business status.

Although we may attempt to maintain accurate information, we do not guarantee that every listing, score, statement, review summary, telephone number, address, service category, or other item is complete, current, or error-free.

Businesses may contact us to request corrections or removal in accordance with our listing and corrections policies.

8. No Paid Influence on Editorial Rankings

We may earn revenue from advertising, referrals, lead distribution, featured placements, or other commercial relationships.

Unless clearly disclosed otherwise, referral compensation and lead fees do not determine the editorial scores assigned through our published scoring methodology.

Sponsored, featured, or paid placements may be identified separately where appropriate. A paid placement does not constitute a guarantee of service quality or customer satisfaction.

9. Propane Safety and Emergencies

The Site is not an emergency service and should not be relied upon for emergency propane dispatch, leak detection, fire response, carbon-monoxide response, or professional safety instructions.

Do not wait for a response to an online form when there may be an immediate safety issue.

If you smell propane, suspect a leak, experience symptoms of carbon-monoxide exposure, observe fire or damaged propane equipment, or believe there is an immediate danger:

Leave the affected area when it is safe to do so;
Avoid flames, sparks, switches, and other possible ignition sources;
Contact emergency services and your propane supplier from a safe location; and
Follow instructions provided by emergency personnel or qualified propane professionals.

Information on the Site is general information and is not a substitute for instructions from emergency personnel, your propane supplier, equipment manufacturers, inspectors, or licensed professionals.

10. No Professional Advice

Articles, guides, calculators, comparisons, glossary pages, FAQs, and other Site content are provided for general informational purposes.

Nothing on the Site constitutes engineering, construction, code-compliance, legal, financial, environmental, insurance, or professional safety advice.

You should consult an appropriately qualified professional concerning your particular property, propane system, tank, appliances, generator, business, or legal obligations.

11. User Responsibilities

When using the Site, you agree that you will not:

Submit false, misleading, fraudulent, or fabricated information;
Submit another person’s contact information without authorization;
Impersonate another person or business;
Use the Site to harass providers or other users;
Submit spam or repeated fake inquiries;
Attempt to interfere with the Site’s security or operation;
Introduce viruses, malicious code, or harmful technology;
Scrape, harvest, copy, or extract Site content through automated means without written permission;
Use Site information to create a competing database or directory;
Circumvent access controls or rate limits;
Infringe intellectual-property, privacy, or other legal rights; or
Use the Site for any unlawful purpose.

We may restrict or terminate access, reject an inquiry, or remove submitted content when we believe these Terms have been violated.

12. Intellectual Property

The Site and its original content—including its design, layout, branding, scoring system, compiled directory, written descriptions, summaries, graphics, databases, and presentation—are owned by or licensed to PropaneFL.com and are protected by applicable intellectual-property laws.

You may use the Site for personal or internal business purposes related to locating propane services.

You may not reproduce, republish, sell, license, distribute, scrape, create derivative works from, or commercially exploit substantial portions of the Site without our prior written permission.

Business names, logos, trademarks, and service marks appearing in listings belong to their respective owners. Their appearance on the Site does not imply sponsorship, affiliation, or endorsement.

13. User-Submitted Content

When you submit a message, correction, review-related statement, photograph, document, or other content, you represent that you have the right to provide it.

You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, store, modify, and communicate the submitted content as reasonably necessary to:

Process your request;
Refer the request to providers;
Respond to you;
Investigate listing corrections;
Protect the Site from fraud or misuse; and
Operate and improve the Site.

This license does not authorize us to publicly display your private service-request information as a customer review without additional permission.

14. Third-Party Websites and Services

The Site may link to provider websites, mapping services, review platforms, social-media services, advertising partners, analytics providers, and other third-party resources.

We do not control and are not responsible for third-party websites, services, content, security practices, privacy policies, products, or transactions.

Your use of a third-party service is governed by that third party’s own terms and policies.

15. Privacy

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy.

By submitting information through the Site, you acknowledge that the information may be processed and shared as described in these Terms and the Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all information, listings, matching services, scores, tools, and content are provided on an “as is” and “as available” basis.

We make no express or implied warranties concerning:

Accuracy;
Completeness;
Availability;
Merchantability;
Fitness for a particular purpose;
Non-infringement;
Provider quality;
Provider licensing or insurance;
Pricing;
Propane availability;
Response time;
Safety;
Workmanship; or
Results obtained through the Site.

We do not guarantee uninterrupted, secure, or error-free operation of the Site.

Some jurisdictions do not permit the exclusion of certain warranties, so some exclusions may not apply to you.

17. Limitation of Liability

To the fullest extent permitted by law, PropaneFL.com, its operator, owners, officers, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

Your use of or inability to use the Site;
Reliance on a listing, score, review summary, or other content;
Contact from a provider;
A provider’s acts or omissions;
Propane delivery or failure to deliver;
Tank installation, leasing, inspection, repair, or maintenance;
Property damage;
Personal injury;
Pricing or contractual disputes;
Loss of data, revenue, business, or opportunity;
Unauthorized access to information; or
Any transaction between you and a provider.

To the extent permitted by law, our total liability for a claim arising from your use of the Site will not exceed the greater of:

The amount you paid directly to us for the specific Site service giving rise to the claim during the preceding 12 months; or
One hundred dollars ($100).

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

18. Release Regarding Provider Transactions

To the fullest extent permitted by law, you release PropaneFL.com and its operator from claims arising from disputes between you and a provider, including disputes concerning pricing, deposits, delivery, fuel quality, tank ownership, contracts, property access, workmanship, scheduling, safety, warranties, refunds, cancellations, or damages.

This section does not waive rights that cannot legally be waived.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PropaneFL.com, its operator, affiliates, owners, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and reasonable legal expenses arising from:

Your unlawful use of the Site;
Information or content you submit;
Your violation of these Terms;
Your infringement of another person’s rights; or
Fraudulent, abusive, or unauthorized activity conducted through your account, device, or contact information.

20. Site Availability and Changes

We may modify, suspend, restrict, or discontinue any portion of the Site at any time.

We may add, remove, re-score, reorder, or update listings and content without notice. We are not obligated to maintain any particular provider listing, feature, score, geographic area, or matching relationship.

21. Termination

We may block or terminate your access to the Site if we reasonably believe that you have violated these Terms, misused the Site, submitted fraudulent inquiries, threatened Site security, or acted unlawfully.

Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions—will remain in effect.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the Site must be brought in a state or federal court located in [COUNTY], Florida, and you consent to the personal jurisdiction of those courts.

23. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

24. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

25. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and PropaneFL.com concerning your use of the Site, except for any separate written agreement that you enter into directly with us.

Agreements between you and propane providers are separate agreements to which we are not a party.

26. Changes to These Terms

We may update these Terms periodically.

The updated version will be posted on this page with a revised effective date. Your continued use of the Site after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.
